Evaluate regulatory compliance

APPLICATION

This unit describes the performance outcomes, skills and knowledge required to evaluate compliance outcomes, and review regulatory policies, procedures and legislation to improve compliance outcomes.

 

This unit applies to those working as a manager with responsibility for regulatory officers who enforce and promote compliance with the organisation’s enabling legislation.

 

The skills in this unit must be applied in accordance with Commonwealth and State or Territory legislation, Australian standards and industry codes of practice.

 

No occupational licensing, certification or specific legislative or certificate requirements apply to this unit at the time of publication.

Elements and performance criteria

ELEMENTS

PERFORMANCE CRITERIA

Elements describe the essential outcomes

Performance criteria describe the performance needed to demonstrate achievement of the element.

  1. Develop compliance measures/targets
    1. Develop compliance measures that are valid, reliable, sufficient and both time and cost effective.
    2. Develop realistic measures and/or targets underpinned by current information.
  1. Evaluate extent of compliance
    1. Ensure analysis of compliance data is valid and conclusions are unbiased and supported by evidence.
    2. Ensure interpretation of comparative data over time is valid and reliable and record outcomes.
    3. Report compliance outcomes.
  1. Review procedures and guidelines to improve compliance
    1. Draw upon sources of information representing the breadth of possible stakeholders to ensure review is comprehensive.
    2. Identify possible reasons for not meeting targets or performance indicators as applicable, and make recommendations to improve long term voluntary compliance.
    3. Make adjustments to strategies and plans to address review recommendations in accordance with resource constraints.
  1. Contribute to new legislation or review of existing legislation
    1. Provide input that supports government policy directions and relies on current information with supporting reasons and data analysis.
    2. Convey resource implications of legislative recommendations within government policy requirements.

PERFORMANCE EVIDENCE

Evidence of the ability to complete tasks outlined in elements and performance criteria of this unit in the context of the job role, and each of the following on at least one occasion in relation to a compliance work area or business unit:

  • analyse information
  • interpret complex written and numerical materials
  • prepare written reports requiring formal structure and language relating to evidence based evaluation.

Knowledge evidence

KNOWLEDGE EVIDENCE

Demonstrated knowledge required to complete the tasks outlined in elements and performance criteria of this unit:

  • enabling legislation
  • government policies and legislation that apply to the function of the work group
  • principles of evaluation
  • organisation policy and legislation.

Assessment conditions

ASSESSMENT CONDITIONS

 

 

 

 

Skills must be demonstrated in either:

  • a workplace environment or
  • a simulated environment.

 

Simulated assessment environments must simulate the real-life working environment where the skills and knowledge within this unit would be utilised, with all the relevant equipment and resources of that working environment.

 

Assessment must ensure access to:

  • legislation, policy, procedures and protocols relating to regulatory compliance including evaluation, in the organisation
  • relevant aspects of common law.

 

Assessors must satisfy the Standards for Registered Training Organisations’ requirements for assessors.
